These Terms of Service explain the conditions for using zimozi.au, operated by Zimozi Solutions Pty Ltd (“Zimozi”, “we”, “us” or “our”). Please read them before using the website. If you engage us on behalf of an organisation, you must have authority to enter into the relevant agreement for that organisation.
Paid services require a separately accepted proposal, statement of work or service agreement. Visiting this website, submitting an enquiry or booking an introductory call does not, by itself, commit you to purchasing services.
Our services
We help Australian businesses plan, build and support digital products, including websites, mobile applications, AI solutions and business software. We also offer related design, testing, cloud, maintenance and consulting services.
Your project agreement will identify the contracting parties and set out the agreed deliverables, milestones, fees, payment dates, acceptance process, support arrangements and cancellation rights. That agreement takes priority over these website terms if there is a conflict, subject to rights that cannot lawfully be excluded.
Project fees are payable only as agreed. Quotes and invoices will identify the currency and applicable GST treatment. Additional work, third-party costs or changes to scope require agreement before the related charges are incurred.
Use of this website
You must use our website lawfully. You must not introduce malicious software, interfere with its operation, attempt unauthorised access, impersonate another person or submit material that infringes someone else’s rights.
Website articles, examples and estimates provide general information. They are not a project-specific quote or legal, financial or other regulated professional advice. We aim to keep information accurate and will correct material errors brought to our attention.
The website may include links to third-party websites or services. A link does not imply endorsement. Before using an external service, review its applicable terms and privacy information.
Intellectual property
Website materials are protected by intellectual property laws. You may view, download and print reasonable portions for personal use or internal business evaluation, retaining ownership notices. Other use requires permission unless permitted by law.
Ownership and handover of commissioned deliverables will be recorded in your project agreement, including source code, designs, credentials and any agreed payment conditions. Pre-existing materials, open-source components and third-party products remain subject to their applicable ownership and licence terms. These website terms do not transfer ownership of materials you provide to us.
Client responsibilities
For agreed projects, please provide the information, authorised access, approvals and feedback reasonably needed to deliver the work. You are responsible for having the necessary rights and permissions to supply materials and personal information for the project.
We will explain material dependencies and notify you of anticipated delays. Any resulting changes to delivery dates, scope or fees will be discussed and agreed through the project’s change process. Neither party may impose additional charges solely by changing these website terms.
Warranties and disclaimers
We take reasonable care in maintaining the website, but cannot promise that every page will always be available or free of errors. Maintenance, technical faults and external events may affect access. This does not reduce any obligation we have under an agreed service contract or applicable law.
Our services come with guarantees under the Australian Consumer Law where it applies. These may include guarantees that services will be provided with due care and skill, be fit for a disclosed purpose where applicable, and be supplied within a reasonable time if no time is agreed.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory remedy or other right that cannot lawfully be excluded, restricted or modified. If services fail to meet an applicable consumer guarantee, you may be entitled to remedies such as rectification, cancellation, a refund or compensation, depending on the circumstances.
Limitation of liability
Responsibility for loss arising from use of this website is determined under applicable law. These terms do not impose a blanket exclusion of liability or a monetary cap on claims. Any project-specific allocation of risk must be set out in the relevant agreement and operate consistently with Australian Consumer Law and other mandatory protections.
Neither a website disclaimer nor a project agreement removes liability where doing so would be unlawful. This includes liability for misleading or deceptive conduct and remedies that cannot lawfully be limited.
Governing law
These website terms are governed by the laws of New South Wales, Australia. Subject to mandatory consumer rights, the parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them. This does not prevent you from using a court, tribunal or complaint process available under applicable law.

Please contact us with questions about these terms or concerns about our services. Describe the issue and the outcome you are seeking so we can review it and work towards a resolution. You may seek external assistance or exercise your legal rights at any time.
